Terms of Service

1. Acceptance of Terms

By accessing or using the dploy.in platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

dploy.in provides a cloud application platform that allows you to deploy, manage, and scale web applications, APIs, static sites, cron jobs, and managed databases. The Service includes the web dashboard, REST API, CLI, and all related tools and documentation.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate and complete information and promptly update it if it changes. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Distribute malware, viruses, or other harmful code
  • Send unsolicited communications (spam)
  • Mine cryptocurrency without prior written authorization
  • Host content that infringes intellectual property rights
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Conduct network scanning, crawling, or denial-of-service attacks
  • Resell or redistribute the Service without prior written consent

We reserve the right to suspend or terminate accounts that violate this policy.

5. Payment & Billing

Certain features of the Service require a paid subscription. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We may change pricing with 30 days' notice. Usage-based charges (compute, bandwidth, storage) are billed in arrears based on actual consumption. Overdue invoices may accrue interest at 1.5% per month.

6. Free Tier

The free tier is subject to resource limits as described on our Pricing page. We reserve the right to modify or discontinue the free tier at any time with 30 days' notice. Free tier services may be suspended after 30 days of inactivity.

7. Your Content

You retain all rights to the code, data, and content you deploy on the Service ("Your Content"). You grant us a limited license to host, run, and transmit Your Content solely to provide the Service. We do not access Your Content except as necessary to operate the Service, provide support you request, or comply with law.

8. Service Level Agreement

For paid plans, we commit to 99.9% monthly uptime for the core platform (API, builds, and routing). If we fail to meet this, you are eligible for service credits as described in our SLA documentation. The free tier is provided on a best-effort basis without uptime guarantees.

9. Intellectual Property

The Service, including its design, features, documentation, and underlying technology, is owned by dploy.in and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. Feedback you provide about the Service may be used by us without obligation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DPLOY.IN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

You may close your account at any time through the dashboard settings. We may suspend or terminate your access for violation of these Terms or for any reason with 30 days' notice. Upon termination, your deployed services will be shut down and your data deleted within 30 days, unless you export it beforehand.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

14. Changes to Terms

We may modify these Terms from time to time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Continued use after the effective date constitutes acceptance of the revised Terms.
